Ordering with us constitutes your acceptance and compliance of these terms and conditions of this site and Food inn Ireland which take effect at the time you first access the site or phone us. If you do not accept these terms and conditions, you must not place an order with us nor access this site via the internet or over the phone. Your continued use of this site will mean that you agree to all the Terms of Use. You can only access our full menu and order from us from this website and therefore all orders are subject to these conditions. We reserve the right to amend term and conditions of both KungFu.ie and Food Inn at any time.
The Terms of Use of this Site do not affect your statutory rights as a consumer. Food inn may recondition or re-evaluate these Agreements, including any Food Inn Policies, from time to time. You as a customer, must agree that you will review these Agreements frequently and that your continued use of the Food Inn service demits your acceptance of the updated terms.

The purpose of this site is to engage with our customers and linking them to our restaurant providers in their area that provide takeaway and deliver foods. Our sites are highly user friendly meaning our customers can simply navigate through site effectively allowing a remarkable food ordering experience. Interactive menus allow customers to build and submit orders at the click of a button. Our services are convenient and highly cost-effective.
By registering with our site, members can benefit from viewing their previous order history, rate past orders. Food Inn Ireland also provide products and services to restaurants and other related businesses to help them market their food and manage their business.

2. Intellectual Property

Food Inn and all its properties are registered. All our copyrights, trademarks, properties and its contents are owned by or licensed by Food inn or otherwise used by food inn as permitted by law regulations. Therefore, you may not resurrect, exhibit, modify, broadcast, print, copy, imitate, download, transmit or re-use the materials of Food Inn Ireland for anything unless it’s for personal and non-commercial use. This includes any purpose which publicly re-sells or re-uses the materials, without the permission of food Inn Ireland.
Foodinn.ie and its logo is trademarks of Food Inn Ireland.

3. Limitation of Liability

To the extent authorised by law, Food Inn Ireland provides this Site and content and we make no portrayal or warranty of any kind, demonstrate or implied, regarding the content or availability of this Site, or that it will be timely or error-free, that defects will be corrected, or that the Site or server that makes it available are free of viruses or other detrimental components.
Concerning above paragraph, neither Food Inn Ireland nor Food Inn directors, officers, agents, employees or contractors shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this Site.
Food Inn is an Online ordering solution. Therefore, we are not responsible for the food, drink or product delivered by partner restaurants. We provide a way people to communicate their orders. We hold no responsibility for errors made leading to personal harm, injury, allergic reactions, or death. As much as we try to ensure that our partner restaurants maintain the highest standards possible, the nature of our business means that we cannot be held responsible for the quality of the product provided. This is the sole responsibility of the individual restaurants. Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence or that of our agents or employees.

4. Indemnity

You must secure and hold harmless Food Inn, its directors, officers, employees, agents, vendors, advertisers, partners and suppliers and keep them indemnified against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from your Access to and use of this Site delivered by Food Inn, any breach or violation of the Terms of Use of this Food Inn Platform or your violation of any law or your violation of the rights of any third party.

5. Availability

This Site may not be available during certain time of a day for further upgrades and maintenance. During this time, we will make an attempt to notify customers in advance of any service unavailability. However, this cannot be guaranteed, and we reserve the right to modify or withdraw the service at any time on a given day.

6. Use of date

As a user of this site, you must ensure that you have read and understood all the Privacy Policy of the company before using our service. All the payment details of the customer like your credit card details will be stored securely with Stripe meaning neither our partner and Food Inn Ireland have access to your card details with the exception of the last 4 digits of your card number and card’s expiry date. We use this information nothing but to identify your card and order.

This Site contains links to other websites. Those websites are not under the control of our provider and Food Inn is not responsible for the practices, content or availability of such websites. A link does not imply endorsement of, sponsorship of, or affiliation with the linked site. We provide the links as a convenience only. If you decide to access linked third-party websites, you do so at your own risk, and we will not be held responsible or liable for any loss or damages caused by use of or reliance on any contents, goods or services available on such websites.
You may provide a non-framed link to this Site from any other business or service website but not in any way which gives the impression that we are associated with or have approved such other site unless expressly agreed to by ourselves in writing.

This Site is intended to be accessed by persons located in the Ireland and we make no representation that any information, materials or functions included in this Site are appropriate for use in any other jurisdiction.
By using this Site, you warrant that any personal information provided by you is true, accurate, current and complete in all respects and that you will notify us immediately of any changes to your personal information by updating your member profile on the Site or Contact Us. You are not allowed to register multiple memberships for use by the same person. Violation of this clause may result in termination of your membership. Members' passwords should always be kept confidential and must not be shared or disclosed to anyone. 10. Orders

Food Inn holds no responsibility or liability of the quality or the quantity of any order delivered or collected. It’s a responsibly of the customer to check the all arrived order before accepting it. If a customer has any queries about their order, they should be directed to the partner restaurant.
When an order has been confirmed within the site, this means we have a record of your order and the partner restaurant still has the right to decline the order. If a partner restaurant is unable to fulfill your order, you will be contacted via an email/SMS/phone call stating that your order has been declined. From food preparation to delivering the order is a responsibility of the partner restaurant accepting the order. Incorrect personal details in the account will results in problems or delays in delivery. Please make sure the information you have provided are true and up to date. The person who order should keep their phone/ ordering device and account login details secured. You as a customer, agree to be responsible for orders and chargers made via your device and/or via your account.

11. Alcohol and Tobacco

Orders containing any form of alcohol or tobacco are not eligible to be accepted by a person under the age of 18. You have agreed to not place any order containing these items fi you are below legal age.

12. Payment

Once your order has been accepted, this represent an agreement between the user and partner restaurant and the restaurant has sole responsibility of this order. Payments can be made by both cash and electronically. Cash payments must be made directly to the restaurant who filling the customer order. Credit or debit cards or any other electronic transactions are performed and processed by Food Inn. The payment then will be sent to partner restaurant’s account. Delivery and Payment charges are calculated based on the partner restaurant policies. Process are subjected to change without notice and all the food are subject to availability.

13. Cancellation

As a customer, you have a right to candle an order up the point where the order is accepted by the restaurant. This is usually within 20 second from the point at which you made your order through our website.
An order maybe gets canceled by a restaurant after you have received a notification stating the order has been accepted. Food inn and our partner restaurants reserve the right to candle any order before or after accepting an order and will notify the customer in any cancellation situation.

14. Termination

We reserve to right to remove a user from our food inn accounts or decline a new registration if a user violates any of our terms and conditions. If we consider there is a risk of liability or loss to food inn or any of our partner restaurants, we may take legal actions to prevent such situation occurring.
If a customer got terminated from our food inn accounts, he may not order or re-join our service without our prior written consent. We have the right to assign or sub-contract any or all our rights and obligations under these terms.
In an even of any suspicious activities or breach of term and conditions, please note that we can track and trace your IP address and if necessary, we will contact your internet service provider for further information.

15. Governing Law

The terms and conditions, Privacy Policy and any matter relating to Food inn shall be governed by the Irish law and any dispute shall be resolved exclusively in the courts of Ireland.
